تعقيبا على تقرير نشره موقع تلفزيون سوريا

نشر موقع تلفزيون سوريا بتاريخ 15ـ 6 ـ 2026 تقريرا عن قرار محكمة كوبلنز ببراءة اللاجئ السوري مصطفى معرستاوي المقيم في ألمانيا، وتضمن التقرير تصريحا من معرستاوي ورأيا قانونيا حول إجراءات المحاكمة، التي تناولها تحقيق استقصائي أجراه موقع" BLACK SEA" وتداولته عدد من وسائل الإعلام المحلية والعربية.

وفي تفاصيل القضية؛ قضت محكمة الاستئناف العليا في كوبلنز ببراءة اللاجئ السوري مصطفى معرستاوي من تهم انتمائه لتنظيم الدولة" داعش" وارتكاب عمليات قتل في بلدة الصوانة بريف حمص في العام 2015.

وتبرز أهمية الحكم بعد أن كشفت المحكمة تلفيق تهم لـ معرستاوي، ما دفعها إلى إسقاط الشهادات بعد أن تأكدت من" كيديتها" وصدورها عن شخصيات لعبت دورا أمنيا لدى النظام المخلوع.

واستندت المحكمة في تبرئتها للمتهم إلى انهيار مصداقية الشهود (الذين كانوا إما عناصر في ميليشيات تابعة للنظام المخلوع ككتائب البعث، أو شخصيات متنفذة، أو عائلات تحمل ضغائن شخصية ودوافع انتقامية).

وتيقنت المحكمة أن الأدلة غير كافية لإثبات التهم بما لا يدع مجالاً للشك.

وأثبت المتهم أنه لم ينضم لداعش، وفقد عمله بسبب سيطرتهم على المنطقة، حيث هرب مع عائلته لاحقاً ليعيش في ألمانيا كلاجئ لا يحمل أي فكر متطرف.

وإيمانا من موقع تلفزيون سوريا بالمهنية والتوزان في وجهات النظر وحق الرد، ينشر موقعنا رد منظمة سيجا (CIJA) على عدة نقاط وردت في التقرير.

يحتوي المقال على مغالطات واقعية خطيرة وادعاءات تشهيرية تتعلق بدور وولاية وأنشطة منظمة CIJA.

وقد نُشرت هذه الادعاءات دون أي محاولة لطلب تعليق من منظمتنا أو للتحقق من المزاعم الموجهة ضدنا، وهو ما يتناقض مع المعايير الصحفية الأساسية.

لقد عُرضت هذه الادعاءات على أنها حقائق، وَنُسبت إلى CIJA صلاحيات وسلطات ومسؤوليات لا تمتلكها.

ونتيجة لذلك، يُضلل المقال القراء بشكل جوهري بشأن دور منظمتنا، ويخلق انطباعًا خاطئًا عن سلوكنا وأنشطتنا.

على سبيل الإيجاز: يُلمّح المقال إلى أن منظمة CIJA تعاونت مع النظام.

إن عمل منظمة CIJA في إطلاع الجمهور على الفظائع التي ارتكبها النظام، ومحاكمة المسؤولين عن الجرائم المرتكبة ضد الشعب السوري، هو أمر موثق في السجلات العامة.

ومن الأمور الموثقة في السجلات العامة أيضًا أن المحققين السوريين التابعين لمنظمة CIJA تعرضوا رسميًا للملاحقة من قبل النظام لمنعهم من القيام بعملهم.

لقد طارد النظام المخلوع محققينا السوريين، وسجنهم، وعذبهم.

ورغم ذلك، واصل أكثر من 40 رجلاً وامرأةً سوريًا هذا العمل الخطير بهدف تحقيق العدالة في سوريا المحررة.

إن ادعاءاتكم ليست تشهيرية فحسب، بل إنها تعرّض هؤلاء الرجال والنساء الشرفاء لخطر غير مسبوق بطبيعة الأكاذيب ذاتها التي نشرتموها.

يُنسب المقال إلى منظمة CIJA قرارات وسلطات لا تمتلكها فيما يتعلق بتقديم الدعم للقضايا التي تتابعها أجهزة إنفاذ القانون الغربية، بما في ذلك الأمور المتعلقة بالمحاكمات والنتائج القضائية وغيرها من القرارات التي تتخذها السلطات المختصة بشكل مستقل.

للتوضيح، تقوم منظمة CIJA بجمع المعلومات والأدلة وحفظها وتحليلها، وتقديمها - عند الاقتضاء - إلى السلطات المختصة.

أما القرارات المتعلقة بالتحقيقات والتهم ومقبولية الأدلة والإدانات والبراءات ومسائل الهجرة، فهي تُتخذ بشكل مستقل من قبل المدعين العامين والمحاكم والسلطات الإدارية.

The article contains serious factual inaccuracies and defamatory allegations concerning the role, mandate, and activities of CIJA.

These allegations have been published without any attempt to seek comment from our organisations or to verify the claims made against us, in contravention of the basic journalistic stanards.

You presented these allegations as fact and attributed to CIJA actions, authorities and responsibilites that it does not possess.

As a result, the article materially misleads readers regarding the role of our organisation and creates a false impression of our conduct and activities.

The seriousness of these inaccuracies is compunded by the fact that the article concerns matters relating to criminal accountability processes and makes allegations capable of causing significant reputatiaonal and operational harm.

By way of summary: The article insinuates that CIJA colaborated with the regime.

CIJA´s work to bring the regime´s atrocities to the public knowledge, and to prosecute those responsible for the crimes against Syrian people is a matter of public record.

It is also a matter of public record that CIJA´s Syrian investigators were formally hounded by the regime to stop them from doing their work.

Our Syrian investigators have been hunted, imprisoned and tortured by the deposed regime.

Despite this, more than 40 Syrian men and women continued this dangerous work with a view to bring justice to liberated Syria.

Your allegations are not only defamatory but expose these fine men and women to unprecedented danger by the vary nature of the lies you published.

The article attributes to CIJA decisions and authorities that it does not possess when it comes to providing suport to cases pursued by the Western law enforcement, including matters relating to prosecutions, judicial outcomes, and other decisions that are made independently by competent authorities.

For clarity, CIJA collects, preserves, analyses, and where appropriate provides information and evidence to competent authorities.

Decisions regarding investigations, charges, admissibility of evidence, convictions, acquittals, and immigration matters are made independently by prosecutors, courts, and administrative authorities.

We have supported and continue to support investigations conducted by more than 70 different law enforcement entities in 20 countries and 9 multilateral organisations.

CIJA has been held as an example to follow in terms of the quality of its work which is designed to follow the highest standard of law enforcement.

We have supported 40 convictions and inquiries in more than 1,000 persons of interest.

You have deliberately chosen to hide this record from your readers in order to focus on false allegations regarding two cases proferred by interested parties and misrepresentation of judicial findings.

You have chosen to represent an acquital as a proof of failure when acquittals are a normal and important part of any fair and democratic justice system and reflect the independence of judicial institutions.

You have relied on misinformation presented to you by parties in the case, individuals hiding behind journalism but related to parties in the case, and individuals who have neither the knowledge of the case nor grasp of how cases are brought by the Western law enforcement.

I have attached a document identifying specific statements that are inaccurate or misleading together with factual clarifications.

In light of the nature and extent of the inaccuracies contained in the article, we request that the publication take immediate corrective action.

Specifically, we request that you: 1.

Remove the article in its current form from publication until a review is completed and an objective article published.

Or alternatively, 2.

Promptly publish substantial corrections addressing the factual inaccuracies identified in this letter and in the attached schedule.

At the same time, public a clear editorial notice informing readers that significant aspects of the article were inaccurate.

3.

Publish an apology acknowledging that serious allegations concerning CIJA were published without obtaining comment from the organisaton and that material inaccuracies were included in the article.

And, 4.

Confirm in writing, no later than 23 June 2026, the steps the publication intends to take.

We support accurate and responsible reporting on accountability and justice issues and would welcome constructive engagement to ensure readers receive a fair and factually accurate understanding of our work.

However, given the seriousness of the allegations published and the continuing harm arising from their circulation, we consider this matter to require urgent attention.

Schedule of inaccuracies 1.

You claim that CIJA “built the case”.

This is false.

CIJA does not build cases.

Where appropriate CIJA provides information and evidence to competent law enforcement and judicial authorities investigating serious crimes.

Decisions regarding investigations, charges, the assessment of evidence, and judicial outcomes are made independently by prosecutors and courts.

For the last 10 years 76 law enforcement entities from 20 countries have requested assistance from CIJA in this regard and continue to do so.

This speaks to the quality of CIJA´s work.

2.

You claim that the judgments refered to CIJA´s non-existend files (see point 1) as “worthless”.

This is inaccurate.

In general, you have failed to analyse the judgements and their findings and have chosen to present an acquital together with select partial quotes of evidence of your predetermined conclusion to publish a hit piece on CIJA.

3.

You claim that the cases you refer to expose a “a thriving multi-million-euro for profit war crimes investigation industry”.

This is false.

CIJA is a not for profit organisation that undergoes multiple audits each year.

The work we perform is of the law enforcement standard done at a fraction of the cost and with zero profit.

4.

You claim: This case was built by the International Justice and Accountability Authority (CIJA).

According to Marstawi: “It was the organization that brought witnesses and built the case without verifying the validity of the allegations, but used screenshots of fake Facebook accounts accusing us of being evidence, and tried to exploit all ways to build a case and win it at the expense of us innocent people.

She also concealed our exonerals in court for more than a year, and this is what was stated in a court of Koblenz's court.

Unfortunately, the United Nations 'Neutral Mechanism' obtained the testimony of perjury themselves on the recommendation of CIJA, and simply took the testimonies without verification and participation with the German judiciary, which further complicated the matter.

But the path of the law is clear and the path of justice is also clear.

” This allegation is completely false and has no bearing in facts.

CIJA did not “bring any witnesses”, did not “build a case”, did not “use fake Facebook accounts as evidence” nor did it seek to deliberately keep exonerating evidence away from the court.

In fact, it was CIJA that brought the exonerating evidence to the court the moment it was aware of having the possession of it.

5.

You claim a CIJA director intervened to get individuals asylum in Canada and the Netherlands.

These are defamatory lies.

CIJA director has no knowledge of these individuals nor their status.

Furthermore, CIJA does not have the powers to offer asylum to anyone.

6.

Throughout the article you imply that CIJA “collaborated” with deposed regime figures.

This is a defamatory lie and a stain on the record of our Syrian team that bravely worked to document regime atrocities throughout the war.

This work was done with the permision and under official agreement with the revolutionary council of the Free Syrian Army.

CIJA´s record on exposing the crimes of the regime is very public, arrest warrants issued by the deposed regime to hunt down our colleagues for the work they did are a matter of public record, and you deliberately chose to keep it from your readors to further your goals to denigrate the reputation of our organisation.

You publish opinions of lawyer Anwar Al Buni without having put these same musings before CIJA to refute.

Had you done that, you would be aware that insinuation that CIJA works with international experts alone while other organisations are somehow more Syrian are false.

More than 40 Syrian citizens have been working with CIJA Syria and were throught lead by two Syrian chief investigators.

It is inaccurate to state that when third parties bring information to law enforcement that “when the prosecutor sees a large number of testimonies he has no choice but to move”.

This is not true.

Western law enforcement have a duty to thoroughly check and investigate every piece of information put before them before deciding if there is sufficient evidence to proceed with a case.

To put it simply, neither CIJA nor any other organisation can compell a state to move with the prosecution.

The state has to carry out its own investigation and decide on the basis of that work decide whether to proceed or not.

To imply that any European country would initiate a case solely on the basis of a “file” passed by a third party including NGOs, shows manifest lack of understanding of the complex rules and procedures governing the work of law enforcement in those countries.
